The Protecting Americans from Foreign Adversary Controlled Applications Act (PAFACA), enacted in April 2024, specifically targets applications owned by entities from countries designated as foreign adversaries, with TikTok being a primary focus. The law provides a 270-day window for divestiture, extendable by 90 days if progress toward a sale is evident. Without compliance, TikTok will be removed from U.S. app stores, and internet hosting services will be prohibited from supporting the app, effectively rendering it inoperative over time.
Despite ByteDance’s refusal to sell, potential U.S. buyers have emerged, including former Treasury Secretary Steven Mnuchin and billionaire Frank McCourt. However, no imminent sale appears likely before the deadline.
President-elect Donald Trump, set to be inaugurated on January 20, has expressed a desire to prevent TikTok from going dark in the U.S. He has indicated plans to negotiate a resolution, potentially through diplomatic channels, to address the national security concerns while preserving the app’s availability.
The Supreme Court’s decision underscores the tension between national security imperatives and free speech rights. While acknowledging TikTok as a “distinctive and expansive outlet for expression,” the Court emphasized that Congress has determined divestiture necessary to mitigate well-supported national security risks.
As the January 19 deadline approaches, the future of TikTok in the U.S. remains uncertain. The incoming administration’s actions and potential negotiations will be pivotal in determining whether the app continues to operate or faces a nationwide ban.
