S.C. Tax Relief Law to Protect Heirs’ Property Owners From Sudden Rate Spikes

South Carolina families navigating the complex process of settling heirs’ property claims are getting a much-needed financial shield against sudden property tax spikes.

The Heirs’ Property Tax Relief Act, passed this spring, is designed to protect families from unexpected tax increases tied to property reassessments. This relief is especially crucial during the legal process of subdividing or splitting land that has been passed down through generations without a clear will or updated title.

Heirs’ property typically arises when land is inherited by multiple family members over time without formal estate planning. This lack of clarity often leaves families unaware of their exact legal ownership until a crisis hits, such as a relative’s death, storm damage, or the sudden need to repair or sell the home. Resolving these issues frequently involves costly court appearances and family disputes.

While families will still pay standard property tax percentages under the new law, the legislation prevents the dramatic reassessment jumps that often occur during ownership restructuring. Proponents of the measure emphasize that preventing these tax spikes will save families thousands of dollars—vital funds that can be redirected toward the heavy attorney fees and legal expenses required to clear titles.
