TEGA CAY, S.C. — A new state law in South Carolina regulating golf cart usage is now in effect, requiring that all children under the age of 12 wear a seat belt while riding in a golf cart on public roads. The legislation, signed by Governor Henry McMaster, took effect on May 22, 2025, and applies statewide.
In addition to the seat belt mandate, the law reaffirms that golf cart drivers must be at least 16 years old, possess a valid driver’s license, and only operate on roads with speed limits of 35 miles per hour or less. State law also allows golf cart use only during daylight hours unless a municipality passes a local ordinance permitting nighttime operation.
Golf carts are a popular form of transportation in Tega Cay, frequently used for short trips to local destinations like Windjammer Park, the Beach and Swim Center, and neighborhood gatherings. With the new law in place, Tega Cay officials are preparing to align city codes with state regulations and expand local usage.
On Monday evening, the Tega Cay City Council is scheduled to review a proposed ordinance that would allow permitted golf carts to operate after dark, provided they are equipped with working headlights and taillights. The ordinance would amend Section 50-37 of the City Code, which governs the use of golf carts on public highways and multiuse trails within city limits.
The proposed local changes also incorporate the new child seat belt requirement and reaffirm existing operational rules. These include the need for carts to be registered with the South Carolina Department of Motor Vehicles, carry liability insurance, and display a DMV permit decal, which must be renewed every five years or upon address change.

The City Council’s discussion on the ordinance is open to the public and scheduled for the evening of June 9, 2025.
